Swissray International (OTC: SRYI) After a legal battle Swissray has prevailed in defending its Intellectual Property.
Swissray sued the French company, DMS-Apelem of Nîmes, France for infringement of its European Patent EP862748 «Optical Arrangement and Method for electronically detecting an X-ray Image». This patent refers to a breakthrough development of Swissray which is the core of all Swissray direct digital Radiography systems. As a reaction to the patent infringement claim of Swissray, DMS-Apelem has filed an opposition against the Swissray patent requesting its revocation. On December 2, 2004 the Board of Appeal of the European Patent Office has declared that the Swissray patent EP862748 is valid and that the appeal of DMS-Apelem is without merit. Swissray will now continue the infringement litigation in France against DMS-Apelem and is looking forward to reach a favourable conclusion.
Terry Ross, Swissray’s CEO stated, «This legal decision sends a clear message to any firm that Swissray is in litigation with now or in the future that we have the strength and endurance to fight and prevail no matter how much time and efforts it takes».
